SCCVI Super Travel Driver Terms and Conditions

For services provided by the Society Cooperative des Chauffeurs VTC Independents (SCCVI), you may be required to accept separate conditions which govern your use of these services. Please read these conditions carefully. This includes information about the Service and your rights, as well as other important information. The SCCVI pursues an ideal objective: to guarantee dignified living conditions that respect the laws of your canton and the Federal for its members, mainly VTC drivers. In this context, it can seek to convince its members of the superior interest they have in its duty to achieve its social objective. SCCVI members are independent in matters of social security, people who work in their name and on their own account are independent in their work and bear the economic risk. Aim

1 The cooperative society aims to promote and offer its members the possibility of carrying out an activity as an independent VTC driver in excellent conditions and in their interest.

2 This includes in particular the creation and operation of a digital platform for broadcasting races in the interest of its members and socially responsible.

3 This requires conditions of registration to the platform and use of the platform offering maximum autonomy to its members, while respecting public security, public order, the environment, rules relating to use of the public domain, loyalty in commercial transactions, as well as price transparency. as well as compliance with requirements in terms of working conditions, social standards and the fight against hidden work.

4 To achieve its objective, the cooperative society of independent VTC drivers (SCCVI) collaborates with the competent authorities and with all the institutions supporting its objectives. The cooperative society may carry out other activities which are related to the aim of the cooperative society or which further its aim directly or indirectly.

II. ACQUIRING MEMBERSHIP

1- Admission conditions

1 All people who, cumulatively:

(i) Meet the cantonal and/or federal conditions to exercise the activity of VTC Driver;

(ii) Have cantonal and/or federal authorizations to carry out the activity of VTC Driver;

(iii) Comply with the cantonal and/or federal conditions for exercising the activity of VTC Driver, in particular the obligations relating to the vehicle, road traffic and customers;

(iv) Do not compromise the objective of the cooperative society.

2- Admission procedure

1 The candidate must send their request in writing to the SCCVI recruitment committee. The committee may require the production of documents proving that the admission conditions are met. The committee decides to accept or refuse the request. The deliberations take place behind closed doors. The committee is not required to provide reasons for its decision.

2 If accepted, acquisition of membership remains subject to full payment of the membership fee and the entry fee (100.- CHF).

3 Membership is acquired on the date of full payment of the membership fee and entry fee.

3- LOSS OF MEMBERSHIP

Principle

1 Membership is lost:

(i) By resignation;

(ii) By the death or dissolution of the member;

(iii) By exclusion or forfeiture;

(iv) By the transfer of the share;

(iv) By dissolution of the cooperative society.

Basic principles

1- The Super Travel Driver Application/Web/call center puts you in touch with Users and thus allows you to have the opportunity to provide Rides in Switzerland and in all European countries.

2- Super Travel Driver connects Drivers with Users, in accordance with federal and cantonal regulations in Switzerland.

3- You are directly bound by a transport contract with Users when you carry out shopping for them.

4- You accept these General Conditions of the cooperative society of independent VTC drivers as transport of people on a professional basis. You are free to choose if, when and where you use the Super Travel Driver App/Web/call center.

5- You have the right to terminate these general conditions of use by sending a letter to the Cooperative of Independent VTC Drivers. (sccvi.ch@gmail.com).

Object of the contract

Each independent VTC driver to use our Super Travel Driver Application/Web/call center platform must be a member of the SCCVI. These general conditions of use (hereinafter the "Conditions of Use") govern access and use of the APP/Web/Super Travel Driver call center operated by the Society Cooperative des Chauffeurs VTC Independents (CHE -265.559.058, hereinafter: the Cooperative located in Geneva (Route de Veyrier 54, 1227 Carouge GE). Use of the APP/Web/Super Travel Driver call center (hereinafter "the Application/CT and Web") is conditional on acceptance of these Terms of Use.

The service provided consists of making available through the Super Travel Driver Application/Web/call center a connection platform allowing third party transport service providers registered as users of the application Super Travel Driver (hereinafter "the Driver(s)" or "You") to offer their trips to people looking for a transport/delivery service (hereinafter "the Customer(s)") ; the latter can, through the Super Travel Driver platform, transmit their travel orders directly to the Drivers. The App/Web/CT is aimed at transport cars with driver/delivery used for professional transport of people/delivery (hereinafter "the VTC(s)"). By using the App/Web/CT and its services, you are informed that our platform, the Super Travel Driver application, connects drivers and customers and does not provide transport services. The Drivers (members) of the Cooperative carry out transport services on their own account and under their own responsibility, in complete independence. Each trip carried out by a Driver for a Client will constitute a separate contract concluded directly between these persons only. These Terms of Use can be consulted at any time under the "Help" section of the application or on the website www.sccvi.com. Any modification of these Conditions of Use will be made by SCCVI during the General Assembly of SCCVI in the presence and vote of all members of SCCVI and you are free to formally accept or reject them in order to continue using the App /Web/CT. Depending on their importance (price, operational conditions, etc.), they should be discussed and approved at the SCCVI assembly. SCCVI undertakes to ensure that any modification of the conditions of use always guarantees the independence of drivers (members of SCCVI), by guaranteeing them an income allocated without charge and dignity in their activities while respecting ethics and laws. By accepting these General Conditions of Use, you choose to be independent in the use of the Application/Web/CT Super Travel Driver. These general conditions of use constitute a joint enterprise and we are all responsible for the success of this project.

1- Conditions of use of the App/Web/CT application

1 Eligibility You have no obligation to connect or use the App/Web/CT Super Travel Driver. You can log in to the App/Web/CT Super Travel Driver whenever and wherever you want. To use our App/Web/CT Super Travel Driver platform you must hold a professional/Taxi driver card or any other authorization allowing you to professionally exercise the activity of Taxi or VTC Driver in accordance with applicable legislation. The Cooperative will ask you to provide the following documents (required by law) when registering on the platform:

- A valid mobile phone number;

- Your recent ID photo in passport format;

- Your work permit; (valid) - Your double-sided 121 driving license; (valid)

- Your AVS/health insurance card; (valid)

- The registration document for your vehicle mentioning the possibility of transporting people on a professional basis; (valid)

- Your VTC/Taxi card; (valid)

- Your airport transport badge; (valid)

- Your certificate of affiliation with a compensation fund (independent status) or (proof of current affiliation request), (valid)

- Your VAT number;

- Your home address.

In order to use the platform and receive your payments you must also have an account on a payment platform compatible with the Super Travel Driver platform.

2- Driver Account

Use of the App/Web/CT Super Travel Driver requires installation of the software and your registration as a user (hereinafter the "Driver Account"). Opening this Driver Account implies that you submit to the Cooperative and any possible personal data such as your first and last name, address, scan of your identity document, your professional Taxi or VTC card, your driver's license circulation of your vehicle, a photo of you, your legal email address, your telephone number, your self-employed certificate (or proof of current affiliation request), and consent to their processing. You will also need to provide your bank details and/or credit card details before you can use the platform. The SCCVI may be required to request the communication of additional information or documents in the event that the information or documents that you have communicated are difficult to read, are incorrect or that additional verifications are necessary for legal needs.

The use of the Application by the Driver is conditional on the communication of all the documents and information requested by these Conditions of Use. You certify that all registration information provided to SCCVI is accurate and you agree. To update this information in a timely manner. The SCCVI is not liable if a Driver enters incorrect payment information and bank details. In the absence of accurate, complete and up-to-date information, you may no longer be able to access the service. The email address you provided during registration will be used for communication purposes with the SCCVI and will also be your means of communication with your Customers. Each trip invoice that you issue via The App/Web/CT Super Travel Driver for your customers will be sent to them automatically by email with your first and last name as the sender information, and your email address as the reply address. For complaints, your Customers will be able to contact you directly via this email address (for example by replying to the invoice email) or your telephone number. Neither the SCCVI nor any possible subcontractor will have any access to these communications between you and your Customers because they take place outside of the App/Web/CT Super Travel Driver.

3- Multiple vehicles and vehicle sharing with a Partner Driver

Provided that all the conditions required by law are met, you will be able to register several vehicles under your Driver Account and also share your vehicle(s) with other Drivers. Before any use, the Driver will make sure to indicate in the App/Web/CT which vehicle he is in.

4 Driver Behavior

You undertake not to allow anyone else to use your driver account in order to ensure the reliability and confidentiality of your identifiers or passwords and to respect the rules and regulations relating to the professional activity of car transport. SCCVI may suspend or terminate this Contract, particularly in the event of fraud, illegal behavior or non-compliance with the law by the Driver (e.g. revocation of driving license, fraud, serious misconduct, etc.). The SCCVI Disciplinary Commission, constituted in accordance with the rules approved by the SCCVI Assembly, takes any decision in accordance with this article. It will automatically inform the PCTN or any competent authority of facts likely to fall within its jurisdiction. There must be a grace period of three months before any suspension action, unless there is a valid reason.

5- Data protection policy

At SCCVI, we take the confidentiality and security of our users' information very seriously. When using the App/Web/CT Super Travel Driver, SCCVI will access and collect personal data about you. only when you are connected except for reservations on the App/Web/CT (Online). In order to benefit from a good user experience, and so that the actual geolocation data of the trips you carry out for your Customers via the App/Web/CT Super Travel Driver are correctly reflected in the calculations of the actual trip costs. , we recommend that you authorize, in your phone's settings, the Application to access your location data at all times.

In this way, even if you temporarily use a third-party application during a race (for example a Google Maps type application to guide you through the route), the Application can continue to follow you and calculate the actual distance covered during the race. Otherwise, the running distance recorded by the Application could not precisely take into account the actual distance covered during the race (because this data would not be accessible when the Application is in the background). The SCCVI cannot, in such a case, be held responsible in the event of a calculation error linked to the impossibility of tracing your location throughout the duration of the race. Driver geolocation data is only accessible and collected by our platforms when you are "Online". Access to and collection of geolocation data stops when you indicate to the Application that you are "Offline". The way in which the SCCVI processes personal data collected when using the Application, when creating a Driver Account or in any other way is described in the Privacy Policy accessible under the "Help" section of the 'Application or on the site www.sccvi.ch The Confidentiality Policy is an integral part of these Terms of Use.

6. Operation of our platform and race order By the Customer, call center, WEB site, your private customers.

1 Setting the price

Details of prices can be consulted from the application and are updated by members of the cooperative society of independent VTC drivers. (SCCVI).

2 Service fees.

A. You pay no service fees or commissions and the customer pays.

B. VAT 7.7% on the added value will be due and will be included in the general rate.

C. You pay an annual contribution of 200. - CHF to the SCCV set by the members of the SCCVI.

7- Race request

According to the proposal and the vote and approval of the members of the cooperative (SCCVI), if your vehicle is the car closest to the customer and meets the criteria required by the customer, your vehicle will be offered to him in the list of available cars . On your screen you can see all customer requests and you are free to accept and decline as you wish. You receive booking requests through Super Travel Driver app/web/CT and you can view the details (price, distance, delivery location, destination, date, etc.) and you can accept or decline and schedule your work. If the customer selects your vehicle, the application will inform you and indicate the pick-up location, the estimated distance to get there, the destination address, as well as the estimated price of the trip in the form of a gold range. fixed price. If the race destination is abroad (i.e. outside Swiss territory), the application clearly indicates the country of destination. If the pick-up location is at the airport, you will increase the loading amount depending on the access conditions to the desired airport area, and these charges will be displayed on the boarding page. You will have 10-15 seconds (at SCCVI's discretion) to choose whether to accept or decline the ride.

Your acceptance of the trip implies that a contract is concluded between you and the Customer relating to the trip ordered in your vehicle and the price range or fixed price which was submitted to him. From the moment you accept the trip, you are put in contact with the customer with whom you directly conclude a transport contract. The SCCVI Super Travel Driver only connects you. You will see on your screen the first name, the photo if there is one, the Customer's payment method, and the Customer's pick-up location and will be able to contact the latter by telephone or message. The Client may do the same with you. You may not use your customers' phone number and information outside of the ride or use the customer's information for any third party. Telecommunications transmitted by telephone network such as calls and text messages generate costs payable by the transmitter. When you arrive at the pick-up location, you will indicate to your Customer via the Application that you have arrived. When the race has started (customer in the car with you), the customer will see your name, first name, your professional card number, your photo, and your telephone number and on the postman your email address. If you decline the trip because you are no longer available – which you are free to do – the Customer will be able to select and order another vehicle from their list.

8- Cancellation of the order/cancellation fees

The customer can cancel an order at any time before the start of the race. Any cancellation of an order by the customer more than 4 minutes after its acceptance by the Driver will give rise to cancellation fees and the driver will receive cancellation fees equivalent to a minimum amount set by SCCVI members in AG. The Customer will be informed of this through the Application. Cancellation of an order also covers the situation in which the Customer does not appear in front of the ordered vehicle within 5 minutes from the moment you informed the Customer through the Application of your arrival at the pickup location in charge.

You will then have the option to cancel the race and collect cancellation fees equivalent to a minimum amount decided by the SCCVI in AG. The Customer will be informed via the Application, however, if the Driver is more than 5 minutes late at the pick-up location compared to the time initially estimated by the application, cancellation by the Customer does not give rise to no cancellation fees. You agree that no cancellation fees will be charged to the Customer if the latter cancels their trip less than 4 minutes after your acceptance of the trip (often a handling error).

9- Driver waiting/waiting costs

If the Customer does not appear in front of the ordered vehicle within the first few seconds after your arrival at the pick-up location, a waiting fee of 0.50 CHF (per vehicle category) per additional minute will begin to accrue and will be added to the price of the ride. The Customer will be systematically informed via the Application. You agree that disabled or elderly customers will not be charged for the first 6 minutes. If a disabled or elderly customer does not appear in front of the ordered vehicle within 6 minutes of your arrival at the pick-up location, a waiting fee of CHF 0.50 per additional minute will be added to the price. The customer journey will be systematically informed via the Application.

10- Receipt for cancellation fees

Any cancellation costs will, like the price of a trip, be the subject of a receipt which will be notified to the Customer as soon as possible and which can also be consulted via the Application.

11- Complaints

In the event of complaints regarding a trip, its billing or the service provided, Drivers and Customers will have the possibility of contacting each other directly by telephone (call or text message) or by e-mail in order to find an amicable solution (reimbursement via the Application, apologies, etc.) or, if necessary, to take the necessary measures towards each other (complaint, etc.).

12- Estimated travel time and distance of races on our Super Travel Driver platform

Uses a mapping system to predict distances and time between: - Customer Position, Pick-up Location, and Arrival Location, and - Driver and Customer Position and Arrival Locations and support. The accuracy of distance and travel time estimation are mainly determined by two factors: - The accuracy of the mobile network – and the inherent uncertainty of this criterion; - The precision of the mapping system and the uncertainty of this precision. In both cases, the app will generate estimated distances and times. These estimates will vary at any time based on the following criteria:

- The accuracy of the mapping platform regarding the route it chooses as the fastest route. Some journeys may be made with different routes at different times, depending on traffic variables, such as accidents, roadblocks or traffic jams that the mapping platform may or may not detect.

- Quality of the mobile network used (location/time) when a passenger sends a trip request. Some mobiles can use 4G and others 5G. Full 4G/5G deployment may not be achieved in some locations due to lack of network optimization on the operator side. 13- Race prices

The price range or set price displayed is estimated by our Super Travel Driver platform for each race taking into account the estimated distance (per km) of the race, the estimated duration of the race and the price level applied by the Driver, according to the scales adopted by the members of the Cooperative Society of Independent VTC Drivers (SCCVI) in assembly, within the limits of applicable law. At the end of the race, the Application will determine the "Actual calculated amount of the race" based on the actual data of the race (final time, final distance, waiting costs, tolls) and depending on the price level. For VTCs, the final price (based on the actual calculated amount of the trip) which will be invoiced to the Customer cannot exceed the maximum of the initial price range, which is a guaranteed price. Notwithstanding the above, the final price of the trip could exceed the maximum price of the estimated range or fixed price if for example there are waiting costs for the Driver at pick-up or if the Customer changes destination, such as law requires it. If there are toll, baggage and item charges, which are fees/taxes levied for access to certain roads including bridges or tunnels, they will be added to the fare up to the price. Maximum range or fixed estimated travel which will not be exceeded. In the latter case, before the end of the trip, the Driver will enter in the Application the amount of toll fees, suitcase, items that he has advanced and which will appear on the receipt notified to the Customer by the Driver through the Application. In the event of heavy traffic, the price may be increased, according to the terms provided by the Cooperative in meeting.

A supplement per baggage or objects plus 5 kg will be charged and the amount set by SCCVI members.

14- Payment of the fare by the customer

"Fees" are defined as: the price of transportation services including applicable taxes, waiting fees, cancellation fees and tolls. The Customer can pay the Fees either by debiting the bank card registered in their Customer Account or directly to the Driver in cash. When payment is made by credit card via the Application, this payment is automatically sent to the driver's bank account. A receipt containing all the information required by law will be automatically sent to the Customer as soon as possible and will be available to the Driver on the Application. Drivers have a legal obligation to keep receipts for a minimum period of 5 years. A valid bank card must be registered on the Application by the Customer when opening the Customer Account. When ordering a ride, the Customer will select their payment method, cash or credit card. If there are multiple registered cards, he will select the one he wishes to use. For each trip order, Super the application will carry out, on behalf of the Driver, a pre-authorization on the Customer's bank card for the maximum amount of the price range/set. In the event of pre-authorization failure, the Driver will receive notification that the trip has been canceled due to the failure of the pre-authorization of the Customer's card.

If the Customer has selected the cash payment method and the payment is not made at the end of the trip (it is strongly recommended to cash the amount of the trip before departure), it will be up to the Driver to find an amicable solution with the Customer or, where applicable, take the necessary measures towards the latter (complaint, etc.). SCCVI will not be held responsible for this failure to pay by the Client and this amount will not be owed by SCCVI to the Driver.

15- Driver Payments

The SCCVI Treasurer committee will automatically pay into your bank account the amounts collected during your shopping according to the decision of the SCCVI members in the general assembly once/twice a week. Credit card fees are not passed on to you. You will be able to consult your accounts at any time through your Application.

16- Exclusion of liability

The SCCVI is required, under applicable law, to ensure that Drivers using the Application, web/CT have the necessary authorizations and permits to carry out their activity and must verify, to the extent that can reasonably be required from it, that the Driver uses a vehicle meeting legal requirements. To the extent permitted by applicable laws, the SCCVI, its managers, employees, or service providers cannot be held responsible for any harm or damage, direct or indirect, resulting from or related to your use of the Application/Web/ CT or any service or content linked to this Application, nor in general to any liability induced by a fault which is not serious. In particular, the Cooperative, and where applicable, will not be held responsible for:

(i) any damages resulting from the use or inability to use the Application, including damages caused by malware, incompatible software, viruses or any inaccuracy or omission of information from the Application , its content and related services.

(ii) Indeed, the Cooperative, and where applicable, does not guarantee that the Application and/or related services will meet your needs, be complete, free from errors, omissions, defects or always available, timely, up-to-date, accurate and uninterruptedly accessible.

(iii) the use of electronic means of communication with the Application, Web/CT, in particular damages resulting from a failure or delay in the transmission of electronic communications, a Malfunction of the Internet network or other equipment of reception preventing access to the Application, Incompatibility of the Application with other electronic means, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and virus transmission. (iii) The actions, behavior, attitudes or negligence of the Driver. Any complaint regarding the Transport Services provided by the Driver must therefore be addressed directly to him through the Application and the Driver will be responsible for taking all necessary measures (complaint, amicable solution, etc.). The SCCVI, and where applicable authorized by the latter, may suspend, withdraw permits, interrupt or modify all or part of the Web Application at any time and without notice, in particular for maintenance, force majeure or legal reasons.

(iv) The Application, web will inform you by means of a notification. You acknowledge that the SCCVI, and where applicable authorized by the latter, cannot be held responsible for such suspensions, modifications or interruptions of the Application. –

(vi) The child seat is the responsibility of your customers:

In Switzerland, regarding the safety of children in cars, the same law is in force as in European countries. Some other countries apply much less severe laws, but sticking to Swiss rules is a guarantee of security. There are 3 categories of child seats. For the youngest, up to the age of 18 months or up to a weight of 13 kilos, group 0+ is in force. These are baby carriers in which they travel upside down, looking backwards. For children aged 1 to 4, with a weight between 9 and 18 kilos, group 1 applies. In this category, child seats can be oriented both forwards and backwards. And the 3rd category concerns children weighing more than 18 kilos (so approx. from the age of 4), which are the seats of group 2/3. These are booster seats secured or not by means of a backrest and which must be installed for children up to the age of 12 years or 150 cm. 12/20 Taxi and VTC drivers are responsible for the safety of children up to 12 years old. The driver is responsible for ensuring that passengers wear seat belts during the trip. The driver must ensure that children under 12 years old or less than 150cm tall are properly secured with the appropriate child seat. 17- Booking conditions

100% guarantee for all trips with us, no risk of cancellation on our part.

Minimum cancellation period: 1- For a trip booked 24 hours in advance:

- The minimum cancellation period by you is 24 hours before starting the race.

Please note: If you accept the ride and the customer cancels within 24 hours, you will receive 100% of the ride money.

1- If the race was booked less than 24 hours in advance

- The minimum cancellation period by you is 120 minutes.

- You need to inform the administrator via app or phone to cancel the ride.

Please note: If you accept a ride and the customer cancels within 60 minutes, you will receive 100% of the ride money.

By accepting a booking with SCCVI Super Travel Driver, the first person named on the booking agrees, on behalf of all people named on the booking, that:

Read and accept the SCCVI terms and conditions. You agree to our use of personal data in accordance with our Privacy Policy and are authorized to disclose your personal data on behalf of all persons named in the booking, including, where applicable, certain categories of data (such as information about the health or we have a disabled person). You can get all the scheduled courses based on the service type and category of your vehicle, even if you are offline you get notifications for the scheduled courses through the app, and by clicking on them you will get all course details. You will see it and you can accept or reject it.

Once you have accepted a scheduled ride, you can click on your reservation's calendar to view completed rides and scheduled rides. Once you have accepted the trip you will be responsible for completing this trip and you will receive a confirmation email with all the details. You will also receive a reminder email with all the details 1h30 before the start of your race. If you wish to cancel your ride for any reason, you must cancel the ride at least two hours before the ride begins by calling the phone number on the app so that admin will find another driver for the booked one.

You can start the race just one hour before the race starts, you can click on the race whenever you want and look for your customer. You must be at your customer's pick-up location at the time specified when booking.

When you reach the customer at the agreed time and the customer is not there yet, you can click on the wait button and you will receive charges for the customer's waiting time. You must wait a maximum of 30 minutes and if you do not get any response from the customer, contact the Admin. And in this case, you will get 100% of your ride money after cancellation of the trip due to lack of customer presentation after 30 minutes.

For any change of destination, the customer must agree with you. Since the guest pays extra for the reservation, you must have drinking water and a charger to provide to the guest.

Behavior in the vehicle In the case of transport services provided by the service provider SCCVI Super Travel Driver, the user is obliged to adopt the following rules of conduct:

Throughout the duration of the race, all guests are required to respect the Highway Code, particularly regarding the wearing of seat belts. The user is required to follow the instructions issued by the SCCVI service provider. The SCCVI service provider is responsible for safety during the race. 19- Termination/Resignation

23- Who will manage the application/website/call center?

Experienced teams of Super Travel VTC Technologies software and hardware engineers, under the supervision of the SCCVI administrative board. Super Travel VTC Technologies is responsible for all costs of the application, website, call center and advertising and communications with SCCVI customers and providers. Source of income for Super Travel VTC Technologies:

1- Collection of 10% administrative fees from customers (who must pay 25% of the net profit to the SCCVI in the canton of Geneva only)

3- Joint venture with SCCVI and other partners. 24- Intellectual property

You acknowledge that all intellectual property rights and other rights relating to the Application are the exclusive property of VTC Technologies. These rights include rights related to Super Travel Driver/User software, its databases, trademarks, logos, domain names or other similar rights. These Terms of Use cannot in any way be interpreted as transferring ownership of the Application or any element thereof or its content to users.

Subject to your compliance with these Terms of Use, the cooperative grants you a limited, non-exclusive, non-sub licensable, revocable at any time and non-transferable license (i) to access and use the Application on your personal device for purposes relating solely to your use of the Services, and (ii) access and use of any content, information and related materials that may be made available to you in connection with the Services, in each case solely for your personal, non-commercial use. The Cooperative does not grant any right or license to use its Super Travel names, logos and product names associated with the Super Travel Application and services.
